probate propertiesExecutors, Attorneys & Deputies
One of your first duties is to secure and maintain the value of any assets owned by the deceased or person for who you are acting. If there is a property that is now empty it will be at greater risk and so all reasonable steps should be taken by you to protect it. It is important that regular visits to the Property are continued, as you have a duty to maintain the property and ensure that any damage is repaired. Such as a smashed window. Whether locks should be changed, whether someone has gained access, squatters have moved in. These questions can only be answered by regular property checks. Read more on the importance of property checks for probate properties here. In addition to this - weekly attendance is usually an insurance requirement and without one any empty property insurance is likely to be invalid. |

✓ insure it
Many policies do not cover properties that are unoccupied for 30 days or more and so you may need to cancel the existing policy and arrange a more suitable one. Executors/Attorneys/Deputies must ensure that there is suitable insurance cover in place for the property and should notify the insurer of the the policy holder’s death or when the homeowner vacates it. The fact that the property is empty must be covered by the policy and the conditions of the policy complied with. If there is no insurance in place then an empty property insurance policy should be taken out.
